Purpose and scope
2.1 SnapSell provides a technical service that lets uploaders upload files and make them available to downloaders via a URL for a fee. SnapSell acts only as an intermediary technical service provider and is not the seller, author or publisher of any file.
2.2 These General Terms of Use govern the relationship between SnapSell and the user. If documents conflict, they take priority in this order: (1) any appendices, (2) these General Terms of Use.
2.3 By creating an account, uploading a file, or buying or downloading a file, the user accepts these General Terms of Use.
Eligibility and account registration
3.1 The solution is strictly for adults. Every user represents and warrants that they are at least 18 and have reached the age of majority in their jurisdiction. Any use by a minor is strictly prohibited.
3.2 To register as an uploader, the applicant must complete SnapSell’s identity verification (KYC), which may include government-issued photo ID and confirmation of age. SnapSell may refuse or revoke registration at its discretion where verification fails or fraud, sanctions or money-laundering risk is suspected.
3.3 The uploader is responsible for keeping their account credentials confidential and secure, and is liable for all activity under their account.
3.4 Accounts are personal. An uploader acting through an agency or management company must make sure that everyone using the account is authorised, identity-verified and bound by these terms.
Permitted and prohibited content
4.1 Permitted content. Subject to full compliance with Sections 5 and 6, the solution allows uploading and selling lawful Adult Content that shows only consenting adults (18+). Uploaders remain solely responsible for ensuring each file is lawful in every jurisdiction where it is offered, accessed or downloaded.
4.2 Absolutely prohibited content (zero tolerance). The following is strictly prohibited and leads to immediate, permanent termination, preservation of all relevant data, and reporting to the competent authorities and, where applicable, recognised child-protection bodies:
4.3 AI-generated, avatar and synthetic content. Where a file is AI-generated, digitally created or uses an avatar, the uploader warrants that (a) it doesn’t depict or sexualise any minor; (b) any real person whose likeness, voice or identity is used or trained upon is a consenting adult who has provided written Consent Documentation; and (c) the synthetic nature is disclosed where applicable law requires it.
4.4 Ownership. The uploader must own, or hold all necessary rights and licences to, every file and all material in it. Selling content the uploader doesn’t own or isn’t authorised to sell is strictly prohibited.
- CSAM, or any content depicting, appearing to depict, sexualising or referencing a minor – real, fictional, synthetic or AI-generated – including any depiction of an adult styled to appear as a minor.
- NCII / non-consensual content, including “revenge porn”, hidden-camera, upskirt, deepfake or any intimate content lacking the documented consent of every identifiable person depicted.
- Content depicting non-consenting persons, sexual violence presented as non-consensual, trafficking, coercion or exploitation.
- Bestiality, necrophilia, content depicting serious physical harm or mutilation, or content otherwise prohibited by the rules of the relevant card schemes and payment partners.
- Content that infringes the intellectual property, privacy or personality rights of any third party, or that the uploader doesn’t own or isn’t fully licensed to sell.
- Any content that is otherwise illegal under Swiss law or under the laws applicable to the uploader or the targeted audience.
Age verification
5.1 Performers. Before upload, the uploader must verify that every person appearing in or depicted by a file is at least 18, using valid government-issued photo ID, and must keep the records described in Section 6.
5.2 Buyers. Purchase of Adult Content depends on the buyer passing age verification with our verification provider at the time of purchase. The check applies to the buyer who completes the purchase, not to whoever later uses a download link. The AVS is a mandatory purchase control for Adult Content, not an optional courtesy. Buyers who completed a paid purchase before this verification applied may keep purchasing Adult Content without a new provider check.
5.3 The uploader stays independently responsible for complying with all youth-protection and age-verification laws that apply to their content and audience. SnapSell providing the AVS doesn’t transfer that responsibility to SnapSell, but SnapSell will enforce the AVS as a condition of purchasing Adult Content.
Consent documentation and record-keeping
6.1 For every file showing one or more natural persons, the uploader must obtain and securely keep, for the period required by applicable law and in any case for no less than 7 years: (a) a copy of valid government-issued photo ID for each depicted person showing they were 18+ at the time of production; (b) a signed model release and depiction/sale consent; and (c) the date and place of production.
6.2 The uploader must give us these records promptly on request, and must cooperate with any audit, payment-partner or regulatory request. Failing to produce valid records on request entitles SnapSell to remove the relevant files and suspend the account.
6.3 Custodian of records. The custodian of records for SnapSell-related compliance enquiries is: FABS Media GmbH, Roosstrasse 53, 8832 Wollerau, Kanton Schwyz, Switzerland.
Uploader obligations, warranties and indemnity
7.1 On each upload, the uploader warrants that the file complies with these terms, that all depicted persons are consenting adults with valid Consent Documentation, and that the file is lawful in the jurisdictions where it is offered.
7.2 The uploader will use the solution lawfully, won’t circumvent the AVS or any safety measure, and will respect the rights of third parties.
7.3 The uploader will indemnify and hold SnapSell harmless against any third-party claim, regulatory action, fine, chargeback or loss arising from the uploader’s files or breach of these terms, including reasonable legal costs.
Acceptance and modification
8.1 Users must accept these terms to use the solution. SnapSell may modify them for legal, regulatory, payment-partner or technological reasons and will notify users in writing of significant changes.
8.2 Changes take effect 15 days after notification (or immediately where the law requires it, or to address an imminent legal or safety risk). During that 15-day period a user may terminate this agreement without penalty.
Refund eligibility
9.1 Incorrect content: a buyer is eligible for a refund where what they received is significantly different from the uploader’s description.
9.2 Non-delivery: a buyer may request a refund where content isn’t delivered within a reasonable time (normally within 24 hours) after the purchase is completed.
9.3 Technical issues: a buyer may be eligible for a refund where technical issues prevent access or download and can’t be resolved promptly. In that case the uploader has no claim for damages against SnapSell.
9.4 Duplicate transactions: duplicate charges for the same content caused by a processing error may be refunded.
9.5 Non-refundable: subjective dissatisfaction, change of mind after download, purchases made by mistake but downloaded, or content that meets its description but not the buyer’s expectations.
9.6 Process: a buyer must contact support@snapsell.org within 14 days of purchase with the transaction details, the reason for the refund and any supporting evidence.
Right of withdrawal (consumers in the EU/EEA)
10.1 Where mandatory consumer law gives a buyer a right of withdrawal for digital content, the buyer expressly consents to immediate performance (delivery/download) and accepts that, by starting the download, they lose the statutory right of withdrawal for that file.
10.2 This section doesn’t limit any refund rights under Section 9 or any mandatory consumer protection that can’t be waived under the buyer’s home law.
SnapSell’s obligations
11.1 SnapSell will make the solution available on a commercially reasonable basis, except in cases of force majeure or scheduled maintenance, and holds the rights needed to operate it.
11.2 SnapSell may use automated and human moderation, hash-matching and detection tools to identify prohibited content, and may remove or restrict content to comply with the law, payment-partner rules or these terms.
Complaints, notice-and-action and takedown
12.1 Anyone can report content they believe is illegal, infringing, non-consensual or otherwise in breach of these terms to report@snapsell.org (or our dedicated reporting form). Reports should identify the content (URL), the reason, and the reporter’s contact details.
12.2 SnapSell reviews reports promptly. Suspected CSAM or NCII is treated as an emergency: the content is removed or disabled immediately, relevant data is preserved, and the matter is escalated to the competent authorities and, where applicable, recognised child-protection bodies.
12.3 Anyone depicted in a file can request removal at any time and withdraw consent for future sale; SnapSell will action verified removal requests without undue delay.
12.4 SnapSell will act on valid orders from competent authorities and will keep a point of contact for authorities and users as required by applicable law (including, where applicable, Regulation (EU) 2022/2065 – the Digital Services Act).
Liability
13.1 SnapSell acts only as a technical intermediary and isn’t liable for user-generated content, except to the extent it has actual knowledge of illegal content and fails to act.
13.2 To the maximum extent the law allows, SnapSell isn’t liable for indirect or consequential loss. Nothing in these terms excludes liability that can’t be excluded by law (including for intent or gross negligence, or for harm to life or health).
13.3 Users are responsible for damage caused by their use of the solution.
Payment flows
14.1 Payment services are provided by third-party processors under their own terms. The uploader acknowledges that adult content is subject to specific card-scheme and processor rules, and that processing may be restricted, delayed, held in reserve, or refused accordingly.
14.2 SnapSell may apply rolling reserves, hold funds, or claw back amounts in connection with chargebacks, refunds, fraud or suspected breaches. SnapSell isn’t liable for payment issues caused by incorrect user information.
14.3 Users must not use the solution for money laundering, sanctions evasion or any unlawful financial activity, and must provide the information reasonably needed for AML/KYC and sanctions screening.
Fees
15.1 Service fees are shown on the SnapSell pricing page, the download page and/or the application unless agreed otherwise in writing. SnapSell may revise fees; for fee increases or new fees affecting a service currently in use, SnapSell will give the uploader at least 30 days’ notice (or longer where the law requires it).
15.2 Collection. Users are responsible for making sure all fees, taxes and amounts owed are paid when due. SnapSell may deduct, recoup or offset amounts owed from any reserve, payable balance, linked bank account, or other associated SnapSell account, and may convert currencies at its applicable rate. In case of default, interest may be charged at 9 percentage points above the ECB base rate, plus reasonable reminder fees; the user may prove that lower or no damage was incurred.
Taxes
16.1 Fees exclude all taxes unless stated otherwise. Uploaders are solely responsible for determining, collecting, reporting and remitting any taxes on their sales, and for giving SnapSell accurate tax-status information on request. SnapSell may file informational returns and send tax-related documents as the law requires.
Intellectual property
17.1 SnapSell owns all rights in the application and download pages. Users get a limited, revocable, non-transferable licence to use the solution in line with these terms. Uploaders grant SnapSell a limited licence to host, process, display and deliver their files solely to operate the solution.
Data protection
18.1 SnapSell processes personal data in line with the Personal Data Regulation and its Privacy Policy. SnapSell acts as controller for its own processing and as processor where applicable. Compliance and safety records (including Consent Documentation and age-verification records) are kept for the periods the law requires.
Duration, suspension and termination
19.1 These terms take effect on acceptance and continue until terminated. SnapSell may suspend or terminate access, with or without notice, for breach of these terms, legal or payment-partner requirements, or risk to the solution or third parties. Breaches relating to CSAM, NCII or age verification result in immediate, permanent termination.
Governing law and jurisdiction
20.1 These terms are governed by the laws of Switzerland, and disputes fall under the courts of Kanton Schwyz. This doesn’t deprive a consumer of the protection of mandatory provisions of the law of their country of habitual residence.
Miscellaneous
21.1 If any provision is found invalid, the rest stay in effect. SnapSell may assign these terms in connection with a corporate restructuring. These terms, including any appendices, are the entire agreement between the parties regarding the solution.
